Important Notice: Arbitration Agreement
This Agreement includes an arbitration agreement. By using our Service, you agree to resolve disputes through binding arbitration and waive the right to a jury trial or class action. See Section 11 for details.
1. Eligibility
- You must be 18+ OR 13+ with parental consent
- You must provide accurate information
- You are responsible for account security, including: maintaining confidential login credentials, using secure passwords, monitoring account activity, and immediately notifying us of any unauthorized access
Account sharing is prohibited. Your account is for your exclusive use. Sharing your account credentials or allowing others to access your account is strictly prohibited.
2. Geographic Availability
The Service is currently available to users in the United States. We may expand availability to additional regions at our discretion. You are responsible for compliance with all applicable local laws.
State-Specific Requirements: Some states have stricter privacy and consumer protection laws that may apply to your use of the Service. See Appendix A for California-specific requirements and protections. Additional state-specific provisions may be added as applicable.
3. Service Description
Athlete Intro is a profile platform—not a recruiting service. We provide:
- Profile creation and hosting
- Gated content with access code protection
- Profile update reminders
- Audit logging of all profile changes
- Educational resources, including recruiting guides and AI prompt tools, provided as informational starting points only
We do NOT:
- Create or post athlete profile content on your behalf (educational resources such as the Recruiting Guide are authored by Athlete Intro as informational tools, not personalized advice)
- Guarantee recruiting outcomes
- Contact coaches on your behalf
- Provide recruiting coaching
- Independently verify user-submitted data (unless marked "Verified")
4. User-Submitted Data
All profile information is submitted by:
- You (the athlete or parent/guardian), OR
- Authorized editors you have granted access
You are responsible for:
- The accuracy of all information in your profile
- Authorizing appropriate editors
- Reviewing changes made by editors
- Ensuring you have all necessary rights and permissions for any images, videos, or media you upload
- Obtaining consent from any individuals who appear in photos before uploading
You represent and warrant that:
- You have all necessary rights to the content you submit
- Your content does not infringe any third party's intellectual property, privacy, or other rights
- All information you provide is accurate and not misleading
- You own or have explicit permission to use all images, and have obtained consent from any person(s) appearing in uploaded images (or their parent/guardian if minors)
- You have the legal right to grant Athlete Intro the license described in Section 7 below to include images, data, and content on the Platform and within the athlete's profile on your behalf
You acknowledge that you are solely responsible for any legal claims arising from your uploaded content, including claims related to copyright infringement, violation of privacy rights, or unauthorized use of someone's likeness.
We maintain audit trails of all changes for accountability.
5. Pricing & Payment
Current pricing is available at our website or by contacting info@getzoptic.com. Payments processed through Stripe. All sales are final—no refunds except as specified in our Payment & Refund Policy.
6. User Responsibilities
You agree to:
- Provide accurate information
- Not misrepresent your identity or achievements
- Not falsely claim data is "Verified" when it is not
- Comply with our Platform Policy
- Only upload images, media and content which you have proper ownership and permission
- Obtain consent from all individuals appearing in uploaded images
- Not violate any third party's intellectual property, privacy, or publicity rights
7. Intellectual Property
- Athlete Intro owns its trademarks, designs, and content
- You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content as necessary to provide the Service
- By uploading content, you confirm you have the rights to grant this license and that doing so does not violate any agreements you have with third parties
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, ERROR-FREE, OR UNINTERRUPTED, OR THAT IT WILL MEET YOUR REQUIREMENTS. WE MAKE NO GUARANTEES REGARDING RECRUITING OUTCOMES OR THE ACCURACY OF USER-SUBMITTED DATA.
EDUCATIONAL RESOURCES PROVIDED THROUGH THE SERVICE, INCLUDING THE RECRUITING GUIDE, AI PROMPT TOOLS, AND EMAIL TEMPLATES, ARE INFORMATIONAL ONLY AND DO NOT CONSTITUTE LEGAL, FINANCIAL, OR RECRUITING ADVICE. ATHLETE INTRO MAKES NO GUARANTEES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF INFORMATION IN THESE RESOURCES. NCAA, NAIA, AND NJCAA RULES CHANGE FREQUENTLY. ALWAYS VERIFY INFORMATION DIRECTLY WITH THE APPLICABLE GOVERNING BODY AND EACH SCHOOL.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHLETE INTRO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING YOUR CLAIM, OR $100, WHICHEVER IS GREATER.
ATHLETE INTRO IS NOT LIABLE FOR ANY CLAIMS ARISING FROM YOUR UPLOADED CONTENT, INCLUDING CLAIMS OF COPYRIGHT INFRINGEMENT, VIOLATIONS OF PRIVACY RIGHTS, OR UNAUTHORIZED USE OF AN INDIVIDUAL'S LIKENESS.
10. Indemnification
You agree to indemnify, defend, and hold harmless Zoptic, LLC, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your breach of these Terms
- Your violation of any third-party rights
- Content you submit to the Service
- Your use of images or other media without proper permissions or consents
- Claims of copyright infringement, privacy violations, or unauthorized use of likeness arising from your uploaded content
11. Dispute Resolution
Informal Resolution:
Before initiating arbitration, you agree to contact us at info@getzoptic.com to attempt informal resolution. We will attempt to resolve the dispute within 60 days.
Binding Arbitration:
If informal resolution fails, any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration Venue:
Arbitration shall take place in Colorado, or another mutually agreed location.
Class Action Waiver:
All disputes shall be resolved on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Opt-Out:
You may opt out of arbitration within 30 days of accepting these Terms by sending written notice to info@getzoptic.com.
Survival:
This arbitration agreement shall survive termination of your account or these Terms. The dispute resolution provisions apply to any disputes arising from or related to these Terms, even after you stop using the Service.
12. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
13. Termination
- You may delete your account at any time
- We may terminate accounts for violations
- No refunds for unused subscription time
14. General Provisions
Severability:
If any provision of these Terms is found unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver:
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.
Entire Agreement:
These Terms, together with the Privacy Policy and other policies referenced herein, constitute the entire agreement between you and Athlete Intro regarding the Service.
